For a spousal petition, USCIS is not simply confirming that a marriage certificate exists. The agency evaluates whether the marriage was entered in good faith and not solely to obtain an immigration benefit. The official Form I-130 instructions identify examples of evidence, including shared property, a joint lease, combined finances, children, affidavits, and other documentation showing an ongoing marital union.
Organize evidence by time and subject
Useful categories often include housing, finances, insurance, travel, communications, family events, photographs, and records showing shared responsibility. Within each category, chronology matters. A few well-chosen records covering the relationship can communicate more than hundreds of unexplained pages from one month.
Explain what the documents cannot show by themselves
Not every legitimate couple combines finances in the same way. Some live apart temporarily because of work, school, military service, caregiving, or immigration restrictions. Those facts do not disappear because the file lacks a joint lease. The record should identify the circumstance and support the truthful explanation with available evidence.
Check consistency before filing
Compare names, addresses, dates, employment histories, prior marriages, travel records, and answers across every form. Minor mistakes can create avoidable confusion. Material inconsistencies require more than editing. They require an accurate explanation and, in some cases, legal analysis before submission.
Never create evidence to fill a gap
Backdated agreements, staged transactions, false affidavits, and manufactured records can cause damage far beyond the original weakness. If the evidence is limited, the correct response is to understand why, gather legitimate proof, and decide whether the record is ready.
